Terms of use

Article 1 — Purpose

The purpose of these terms of use is to define the conditions under which the Operator authorises MDE to use certain content (factual data, texts, visuals) relating to its programming in order to integrate them into the Oslo Culture mobile application distributed on the Apple and Google stores.

Article 2 — Content covered

2.1. Factual data

The Operator authorises MDE to freely use the following data: event titles; dates, times, duration; venues; artistic cast; categories and types of shows; prices and pricing information; links to official pages.

2.2. Descriptive texts

Subject to any third-party rights, the Operator authorises MDE to reproduce the textual descriptions of shows for the purpose of informing the public. When certain texts are subject to restrictions (dramaturgical rights, co-producers, rights holders), the Operator undertakes to inform MDE.

Article 3 — Scope of rights granted

The licence granted includes the following rights: reproduction of content in the application; communication to the public via the mobile application; storage of content in an internal database and on servers located in Europe; technical adaptation (compression, cropping required for mobile formats); distribution of announcements.

The licence is: non-exclusive; non-transferable; territorially limited to the European Union; granted for the duration of the terms of use only.

Article 4 — Obligations of the Parties

Article 5 — Intellectual property

The content provided remains the exclusive property of the Operator and/or the relevant rights holders. These terms of use do not effect any transfer of copyright, neighbouring rights or trademark rights.

MDE acknowledges that the content is provided for purposes strictly defined by the purpose of the terms of use.

Article 6 — Financial terms

The authorisation is granted free of charge, in recognition of the value of the Operator's cultural mission and the contribution of the Oslo Culture application to the promotion of artistic activities. MDE will make the Oslo Culture application available to the public free of charge on the Apple and Google stores.

Only the Ville Culture Services, made available by MDE to the Operator, may be subject to a commercial transaction.

Article 7 — Data protection (GDPR)

No personal data is transmitted by the Operator under these terms of use. No personal data belonging to the mobile application users will be transmitted to a third party.

The terms of use and privacy policy of the mobile application will be transmitted by MDE to the Operator for information before being made available on the stores.

Article 8 — Liability

The Operator is responsible for the accuracy of the information provided. MDE is only responsible for the proper technical integration of the content and the security of the application.
